Medical Malpractice

Doctors and other medical professionals owe their patients a standard of care.  A necessary element of medical negligence is that the failure to meet the accepted “standard of care” causes an injury and results in harm. The “standard of care” used to determine whether a doctor or other medical professional has committed medical malpractice is generally based on how a comparably qualified professional should have acted in the same or similar situation.

Examples of  medical malpractice include but are not limited to the following:

  • Failure to diagnosis or delayed diagnosis of cancer
  • Negligent care at nursing homes that lead to injury
  • Medication errors that result in injury
